1. Agreement
By using APEX, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. The service
APEX provides AI-assisted fitness and wellness coaching, progress tracking, and related software features. The product is in early beta and may change. AI outputs can be wrong or incomplete—use your own judgment.
3. Eligibility
You must be at least 13 years old to use Apex Fitness. If you are under 18, you should use the service only with permission from a parent or guardian. You may not use APEX where prohibited by law.
4. Accounts
Keep your login credentials secure and your account information accurate. You are responsible for activity under your account.
5. Subscriptions
APEX Free offers limited features. APEX Pro is a paid subscription with additional features described on our pricing page. We may adjust features or pricing as the product develops.
6. Billing
Paid plans are processed by Paddle.com Market Ltd as Merchant of Record. Your payment relationship for subscriptions is with Paddle; Apex Fitness provides the software service. Taxes may be applied by Paddle based on your location.
You authorize recurring charges until you cancel. Failed payments may suspend Pro access.
Refunds are governed by our Refund Policy: all purchases are non-refundable unless required by law.
7. Cancellations
You may cancel a subscription through billing options in your account. Cancellation stops future charges; access usually continues until the end of the paid period.
8. AI-generated content
Coaching text and recommendations are generated by AI. Do not rely on APEX for emergencies. In an emergency, contact local emergency services.
9. Your responsibilities
Use APEX lawfully and safely. You are responsible for your training decisions and for the accuracy of information you submit.
10. Acceptable use
Do not abuse the service, attempt to bypass limits, scrape or attack our systems, harass others, or use APEX to provide regulated medical care without proper licensure.
11. Intellectual property
APEX branding, software, and content belong to Apex Fitness or its licensors. You receive a limited license to use the service for personal purposes. You retain ownership of data you submit; you grant us permission to use it to operate and improve APEX as described in the Privacy Policy.
12. Disclaimers & liability
APEX is provided “as is” to the extent permitted by law. We are not liable for indirect or consequential damages arising from your use of the service, except where liability cannot be excluded under applicable law.
13. Termination
We may suspend or terminate access for violations of these Terms or to protect the service. You may stop using APEX at any time.
14. Changes
We may update these Terms as Apex Fitness matures. Continued use after updates constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Philippines, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
